Basic Terminology
Koha Consultants Private Limited ("MagoStays") offers a range of accommodations, including villas, bungalows, farmhouses, and homestays, all under the "MagoStays" brand. The following Terms and Conditions apply to all guests or customers who book any of these properties or individual rooms via our website, mobile app, third-party websites, apps, or through travel agents, advertisements, or referrals, collectively referred to as "Booking Channels." Guests are required to read and understand these Terms and Conditions before making a booking through any of these channels. By completing a booking, you agree to be bound by these Terms and Conditions. If you do not agree, please refrain from using the website or any Booking Channel to make a reservation.
These Terms and Conditions may be updated by MagoStays at any time without prior notice, and updated terms will take effect immediately upon posting. MagoStays may also modify or enhance its services without notice. We recommend reviewing these Terms and Conditions regularly. Continued use of the website constitutes acceptance of any updates.
Unless additional terms are provided separately, these Terms and Conditions supersede all prior representations, agreements, or understandings and take precedence, even where they differ from other terms related to any order or service provided by MagoStays.
For both online and offline bookings made through our platform, the following terms are defined as:
(a) "Property/Properties" refers to villas, bungalows, farmhouses, and homestays available for booking through any Booking Channel.
(b) "Guest/Guests" refers to individuals, companies, or other entities booking any Property through any Booking Channel. Guests may also be referred to as "you" or "your."
(c) "Booking" means a reservation made by a Guest for any Property for accommodation purposes.
(d) "Check-In" is the scheduled date and time by which Guests must complete all check-in formalities required by MagoStays, after which they may begin using the reserved property.
(e) "Check-Out" is the scheduled date and time by which the Guest must vacate the Property after completing all required check-out formalities with MagoStays.
(f) "Booking Period" refers to the duration between the scheduled Check-In and Check-Out.
(g) "Booking Amount" is the total amount payable by the Guest to MagoStays to confirm the Booking through the registered payment method, as communicated by MagoStays.
(h) "Booking Confirmation" is the communication shared by MagoStays with the Guest upon receipt of the Advance, detailing the Booking including Terms & Conditions, guest names and count, Check-In and Check-Out details, property name, number of rooms, total Booking Amount payable, Security Deposit amount, and payment due dates. MagoStays is not obligated to serve a Booking unless the entire Booking Amount has been received, even if a Booking Confirmation has been issued. Guests must present the Booking Confirmation and proof of full payment at Check-In.
(i) "Advance" is the non-refundable deposit required to secure a Booking for a Property.
(j) "Security Deposit" is an amount that may be collected from Guests on a case-by-case basis, which MagoStays may use to recover costs for any damages caused to the Property or its contents by Guests or their pets, or for any other applicable charges.
(k) "Peak Days" include long weekends and festive occasions such as Diwali, New Year's, Christmas, and similar events.
Acknowledgement and Express Consent
Your use of this website is governed by these Terms and Conditions, together with our Privacy Policy and all other policies listed on the MagoStays website. These terms form a binding agreement between you and MagoStays regarding your use of this website and the services it provides. By accessing, browsing, or otherwise using this website or any of our services, and by completing a Booking, you confirm that you have read, understood, and agreed to all terms and conditions on the website, including the Privacy Policy.
The pages of this website, their content and infrastructure, and the online accommodation reservation services provided through this website ("the Services") are owned, operated, and provided by MagoStays and are intended for your personal, non-commercial use only, subject to the terms outlined herein.
Eligibility
Use of our Booking Channels to make a reservation is restricted to individuals who are legally capable of entering into binding contracts under the Indian Contract Act, 1872. Individuals deemed 'incompetent to contract' under the said Act are not eligible to use our Booking Channels.
Access and Interference (Online Bookings)
MagoStays grants you a non-exclusive, non-transferable, limited permission to access and display the web pages of this website on your personal device. Failure to comply with the terms, conditions, and notices on this website will result in the automatic termination of any rights granted to you, without prior notice.
Beyond this limited permission, MagoStays does not grant any express or implied rights under any patents, trademarks, copyrights, or other intellectual property rights. You may not copy any content from this website onto another website or any other media. You agree not to use any device, software, or routine to interfere with the proper functioning of this website or any transactions conducted through it. You also confirm that you will not copy, reproduce, alter, modify, or publicly display any content without MagoStays' prior written consent.
Any information you provide to us must not contain viruses, Trojan horses, worms, time bombs, or any other malicious code intended to damage, interfere with, or intercept any system, data, or information.
Description of Services
MagoStays operates as both an online and offline platform for booking Properties. It also provides information about these Properties. The availability of certain amenities or services at a Property at any given time does not guarantee their continued availability, and MagoStays reserves the right to discontinue any amenities or services at its discretion.
Accuracy of Content
MagoStays endeavours to ensure the accuracy of all content on its Booking Channels, website, and mobile application, particularly with regard to rates and property details. However, MagoStays will not be held responsible for any typographical, technical, or other errors on the Booking Channels.
Additional Services
To enhance Guest comfort, MagoStays may, at its sole discretion and subject to availability, arrange additional services such as chefs, housekeeping, or vehicle hire by engaging third-party vendors, upon prior request by Guests. These services may not be included in the Booking Amount, Advance, or Security Deposit and may attract additional charges. Such services are provided solely for the convenience of Guests, without any obligation on the part of MagoStays.
Pricing
The tariffs listed on MagoStays Booking Channels are non-negotiable and may change without prior notice. All rates are quoted per room or per multiple rooms. Tariffs may or may not include applicable taxes depending on the property type. In the event of a technical error resulting in an incorrect tariff being displayed, MagoStays reserves the right to correct the error, and the incorrect tariff will not be enforceable.
Right of Admission and Possession of Property
By making a Booking, Guests acknowledge that they will not at any time possess or claim possession of any Property booked. Guests will not be permitted to check in before the designated Check-In time unless all prescribed requirements are met. Failure to meet these requirements will not entitle Guests to any refund of the Booking Amount or Deposit, nor will any compensation be owed by MagoStays.
(a) Guests must present the Booking Confirmation issued by MagoStays along with proof of full payment of the Booking Amount.
(b) In compliance with government security regulations, every Guest must provide original government-issued photo IDs for verification, along with copies, at or before Check-In.
(c) Guests must enter the names, addresses, and other details of all guests — including children — in the Guest Register maintained at the Property or digitally.
(d) Guests under the age of 18 must be accompanied by at least one adult. If any Guest provides false or incorrect information during Booking, MagoStays reserves the right to cancel the Booking immediately and deny entry to the Property. Guests who have already checked in may be evicted. In such cases, no refund of the Booking Amount or Deposits will be provided.
The total number of Guests, including visitors, must not exceed the number stated at the time of Booking. MagoStays may, at its sole discretion, permit additional persons to stay at an extra charge. No additional persons will be allowed without written approval from MagoStays.
Our Fees
MagoStays reserves the right to apply additional reservation or facilitation fees at any time without prior notice to Guests.
User Terms
By using this website, you acknowledge that you fully assume all risks associated with the transaction, as well as any liability or harm related to any subsequent activity involving the accommodation that is the subject of the transaction(s).
Links to Other Websites
This website may contain links to third-party websites. MagoStays does not endorse or represent these websites or their content and is not responsible for any claims arising from your use of such sites.
Promotional Offers
By sharing your contact details on the website, you agree to receive promotional content from MagoStays via WhatsApp, email, push notifications, and SMS. MagoStays may offer discounts and promotional deals from time to time, subject to specific terms and conditions. MagoStays reserves the right to modify or withdraw any promotional offer at any time without prior notice.
Booking Confirmation
Guests understand that payment of the Advance and/or Security Deposit, or receipt of a Booking Confirmation, indicates acceptance of all Booking details and terms. However, a Booking Confirmation alone does not guarantee a confirmed Booking. MagoStays is not obligated to fulfil a Booking unless the entire Booking Amount is received through the designated payment method. If full payment is not received by the specified due date, the Booking Confirmation will be cancelled and rendered void.
If a Booking is made through third-party platforms, travel agents, or referrals, the Guest must confirm the Booking directly with MagoStays. In cases where a third party's terms conflict with MagoStays' Terms and Conditions, MagoStays' Terms and Conditions will take precedence.
Booking on Hold
Upon receiving the Advance and Security Deposit, MagoStays will place the Booking in a "Booking on Hold" status. The Booking will only be confirmed once MagoStays receives the full Booking Amount through the designated payment method. If full payment is not received by the specified due date, MagoStays will not be obligated to fulfil the Booking.
Check-In and Check-Out Timing
Check-In and Check-Out times are specified in the Booking Confirmation. MagoStays advises Guests not to arrive before the Check-In time, as early arrival may not be accommodated. If Guests enter the Property before the Check-In time, additional charges may apply. Any changes to the Check-Out time must be approved in writing by MagoStays. Guests must vacate the Property by the Check-Out time stated in the Booking Confirmation. Staying beyond this time may attract additional charges.
Payment of Advances, Security Deposits, and Property Damage
To secure a Booking, Guests must pay the Advance before receiving the Booking Confirmation. If the Advance is not received, MagoStays will not issue a Booking Confirmation.
Guests are responsible for inspecting the Property and reporting any pre-existing damage within 90 minutes of Check-In. If no report is made within this period, any damage discovered will be assumed to have occurred during the Guest's stay, and the Guest will be held liable.
Guests must use the Property and its furnishings with reasonable care. At Check-Out, the Property should be left in good condition, with only normal wear and tear expected. If a damaged item forms part of a set and an identical replacement is unavailable, the Guest will be responsible for replacing the entire set.
Guests may not move or relocate any equipment, furniture, or décor from its original position without prior consent from MagoStays, except for movable items such as chairs.
Property inspections will take place between one Guest's Check-Out and the next Guest's Check-In. The Security Deposit, minus any deductions for damages, will be refunded within 30 days of Check-Out. If repair or replacement costs exceed the Security Deposit, the additional amount will be billed to the Guest and must be paid within 7 days. Refunds will be processed by cheque or bank transfer.
Payment Options
MagoStays accepts the following registered payment methods:
Credit/Debit Cards: Visa, MasterCard, RuPay, American Express, and other cards as listed on the Booking Channels.
Net Banking: Payments via internet banking are accepted. Any fees charged by banks or payment gateways are independent of MagoStays, and MagoStays is not liable for such charges.
If full payment is not made, MagoStays will not be obligated to fulfil the Booking.
Financial Details
You confirm that the credit/debit card or other financial details you provide are accurate and legally belong to you. You agree not to use any financial facility that is not lawfully owned or obtained by you. MagoStays is not responsible for any fraud related to payment instruments; liability for any fraudulent use will rest with the Guest.
Pets Policy
Pets may be permitted on the Properties at MagoStays' discretion, as specified in the Booking Confirmation. A non-refundable Pet Fee may be charged. Bringing unapproved pets or pets other than those approved in writing may result in denial of entry or eviction. Approved pets must remain on the Property under the supervision of Guests at all times. Guests are responsible for ensuring that pets do not cause damage, soiling, or nuisance to the Property, its furnishings, or neighbours. Pets are not permitted in the swimming pool or on furniture.
Breach of Terms
Any violation of these Terms and Conditions will result in immediate termination of the Booking, eviction from the Property, and forfeiture of the entire Booking Amount and any other payments made, without any refund.
Cancellations and Refunds
MagoStays reserves the right to cancel a Booking at any time without prior notice to the Guest. For the latest Cancellation Policy, please refer to the Cancellation Policy page on our website.
Safety and Prohibitions
(a) The Property is located in a residential area. Guests must conduct themselves in a manner that does not disturb the peace or privacy of neighbours.
(b) The Property is to be used solely for accommodation purposes and no other use.
(c) Guests must not cause any nuisance to neighbouring properties.
(d) Loud music is not permitted in outdoor areas such as the poolside, garden, compound, balconies, or terraces.
(e) Guests must not use the Property for any unlawful or immoral activities. MagoStays, including its representatives, employees, and agents, will not be liable for any such acts by Guests.
(f) Possession or consumption of prohibited substances and the organisation of rave parties in or around the Property are strictly prohibited. Violation of this condition will result in a Police Complaint being lodged by MagoStays.
Confidentiality and Personal Data
All information collected by MagoStays will be handled in accordance with our Privacy Policy and applicable Indian laws, including:
The Information Technology Act, 2000, as amended.
The Information Technology (Intermediary Guidelines) Rules, 2011, as amended.
The Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, as amended.
Information provided through Offline Booking Channels will also be kept confidential in accordance with these Terms and Conditions.
Intellectual Property Rights
Unless otherwise stated, all software, content, information, and materials available on or used by MagoStays' Booking Channels are the exclusive property of Koha Consultants Private Limited. All rights, titles, and interests — including trademarks, logos, domain names, brand names, designs, and copyrightable works — are exclusively vested in MagoStays.
You are not permitted to copy, publish, promote, integrate, or otherwise use our content or brand without written authorisation. Any unauthorised use will be considered a serious infringement of our Intellectual Property Rights.
Limitation of Liability
Guests acknowledge that MagoStays functions as a booking platform and will not be held liable in the following circumstances:
(a) Accidents, fires, injuries, or deaths resulting from incidents at the Property, including altercations between Guests, caretakers, or other parties.
(b) Illegal or hazardous activities conducted by Guests or their companions, or any resulting consequences.
(c) Criminal acts such as discrimination, harassment, theft, or other unlawful behaviour involving Guests, companions, caretakers, or third parties.
(d) Structural damages, maintenance issues, or malfunctions of electronic devices, swimming pools, or other Property features.
All damage claims must be reported to MagoStays immediately and before Check-Out. Claims made after Check-Out will not be considered. Where MagoStays is found justifiably liable, its liability will be limited to the Booking Amount paid by the Guest. MagoStays' decisions on damage claims will be final.
Guest Issues
MagoStays makes every reasonable effort to provide accurate and realistic depictions of its Properties. If any amenity such as pools, hot tubs, kitchen appliances, electrical systems, or WiFi is not functioning as described, or if there are concerns about cleanliness or other deficiencies, Guests must report these issues in writing or via phone/WhatsApp within 12 hours of Check-In, along with supporting evidence such as photographs.
MagoStays will endeavour to resolve reported issues promptly but will not be liable for any refunds or compensation if issues remain unresolved. MagoStays' decisions in such matters will be final.
If the Property is occupied by other guests at the time of your Check-In, MagoStays will make reasonable efforts to arrange a comparable alternative Property.
Force Majeure
MagoStays will not be liable for any loss or damage incurred during a Booking or while using this website if such loss arises from a Force Majeure Event, including but not limited to strikes, utility failures, transport disruptions, acts of God, wars, riots, natural disasters, epidemics, or pandemics.
Termination
MagoStays reserves the right to terminate your registration and/or your right to use this website for any reason, including any violation of these Terms and Conditions or the Privacy Policy, without prior notice.
Dispute Resolution and Applicable Law
Any disputes or claims arising from a Booking will be referred to arbitration before a sole arbitrator, mutually appointed by the parties, whose decision will be final and binding. Arbitration will take place in Hyderabad under the Indian Arbitration and Conciliation Act, 1996, as amended, and proceedings will be conducted in English. Hyderabad courts will have jurisdiction over all matters subject to arbitration.
Assignment
Bookings made by Guests are non-transferable.
Notices
All notices or communications from MagoStays to Guests will be in writing, sent either by email to the address provided during Booking, or posted on the website or application. Emails will be deemed received on the date they are sent.
Indemnification
By making a Booking, you confirm that it is for personal, private, and residential use only and not for any commercial purpose. You agree to indemnify and hold MagoStays, its affiliates, employees, officers, and agents harmless from any claims, losses, damages, liabilities, costs, and expenses — including legal fees — arising from misuse of our services or any violation of these Terms and Conditions.
Feedback
MagoStays welcomes your feedback, comments, and suggestions for improving our website, application, and services. Feedback may be submitted via email to our support team.
Waiver
MagoStays' failure to exercise or enforce any right or provision of these Terms and Conditions at any time does not constitute a waiver of that right or provision.
Grievance Redressal
MagoStays is committed to providing high-quality services. If you have any grievances regarding any aspect of the website or our services, please submit your concerns via email to our Grievance Officer. All grievances will be addressed promptly.
Submissions
Any messages, ideas, suggestions, or other materials submitted through or in connection with this website will become the exclusive property of MagoStays. By submitting such materials, you agree that MagoStays has the right to use them for any purpose, commercial or otherwise, without compensation to you. You also agree not to submit any materials that infringe upon third-party rights.
Miscellaneous
MagoStays reserves the right to assign its obligations and duties under these Terms to any person or entity. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be fully effective.
